BACKGROUND: The Marion County Builders’ Association will hold a fundraiser (“King of the Wing”) in downtown Ocala on Tuesday, March 26th, 2024, from 5:00 pm to 8:00 pm that will benefit ARC Marion Inc. The event will include food vendors in the downtown Ocala event zone as well as a temporary state license for the Builders’ Association/ARC to sell alcohol (beer and wine).
The Marion County Builders’ Association is also proposing that on-premises licensed vendors within the event zone (see attached Exhibit) be allowed to sell beer, wine, and liquor as part of the event. The following vendors will be participating:
• Harry’s Seafood
• O’Malley’s Alley
• Downtown Billiards
• Mark’s Prime
• The Lodge
• Brick City BBQ
The following businesses with on-premises alcohol permits will not be participating in the event or are located outside of the King of the Wing event zone:
• Bank Street Patio Bar
• Big Hammock Brewery
• Hilton Garden Inn
• Tipsy Skipper/Mutiny Ocala
• Ivy’s on the Square
• Marion Theater
• Agapanthus
• Corkscrew
• Soleil Bakery
• Stella’s Modern Pantry
• La Cuisine
• Cantina
• Sushi Bistro
• Marion Cultural Alliance
• Courtyard on Broadway
• Black Sheep on Broadway
• Sipping Grounds
• Sayulita Taqueria
• Katya Vineyards
• Buzz and Grind
• Symmetry Coffee
Marion County Builders’ Association shall provide a Certificate of Liability insuring the City of Ocala. Marion County Builders’ Association is also working with the Ocala Police Department and other City departments regarding the event layout and process for selling alcohol during the event.
FINDINGS AND CONCLUSIONS: Sections 6-7(b) and 6-9 of the Code of Ordinances, City of Ocala, Florida, provides an exception to allow for possession and consumption of alcoholic beverages on streets, sidewalks, and public parking facilities for special events.
Sections 6-7(b) and 6-9 state that such special events must be recognized and approved by resolution of the City Council at a public hearing.
FISCAL IMPACT: The Marion County Builders’ Association is working with other City departments (Recreation, Public Works, and Engineering) concerning street closures and the Ocala Police Department concerning security during the event.

A RESOLUTION OF THE CITY OF OCALA, FLORIDA, PROVIDING FOR APPROVAL BY THE OCALA CITY COUNCIL FOR THE POSSESSION AND CONSUMPTION OF ALCOHOLIC BEVERAGES (BEER, WINE, AND LIQUOR) FOR A SPECIAL EVENT (2024 KING OF THE WING) ON TUESDAY MARCH 26, 2024 HELD IN DOWNTOWN OCALA FROM 5:00 PM TO 8:00 PM
WHEREAS, Sections 6-7(b) and 6-9 of the Code of Ordinances, City of Ocala, Florida, provides an exception to allow for the possession and consumption of alcoholic beverages on streets, sidewalks, and public parking facilities for special events; and
WHEREAS, Sections 6-7(b) and 6-9 states that such special events must be recognized and approved by resolution of City Council at a public hearing; and
WHEREAS, the Marion County Builders’ Association will hold a fundraiser (“King of the Wing”) in the downtown Ocala event zone on Tuesday, March 26th, 2024, from 5:00 pm to 8:00 pm that will benefit ARC Marion Inc; and
WHEREAS, the event zone will include food vendors on SE 1st Avenue, SW Broadway Street and South Magnolia Ave; and
WHEREAS, Marion County Builders’ Association has provided a description of the type and color of open containers being used during this special event; and
WHEREAS, the Marion County Builders’ Association is working with other City departments (Recreation, Public Works and Engineering) concerning street closures and the Ocala Police Department concerning security during the event; and
WHEREAS, the King of the Wing event is the first of 12 events allowed under Section 6-9 of the code of ordinances for 2024.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session as follows:
1. That the Marion County Builders’ Association/ARC Marion will sell beer and wine in the event zone (see Exhibit “A”) as part of the wing festival on Tuesday, March 26th, 2024, from 5:00 pm to 8:00 pm as required by Section 6-7(b) of the code of ordinances.
2. That the following listed on-premises licensed vendors (Harry’s Seafood, O’Malley’s Alley, Downtown Billiards, Mark’s Prime, The Lodge, and Brick City BBQ) will sell beer, wine, and liquor for consumption in the event zone on Tuesday, March 26th, 2024, from 5:00 pm to 8:00 pm as required by Section 6-9 of the code of ordinance.
3. That the following listed on-premises licensed vendors (Bank Street Patio Bar,
Big Hammock Brewery, Hilton Garden Inn, Tipsy Skipper/Mutiny Ocala, Ivy’s on the Square, Marion Theater, Agapanthus, Corkscrew, Soleil Bakery, Stella’s Modern Pantry
La Cuisine, Cantina, Sushi Bistro, Marion Cultural Alliance, Courtyard on Broadway
Black Sheep on Broadway, Sipping Grounds, Sayulita Taqueria, Katya Vineyards, Buzz and Grind, and Symmetry Coffee) are located outside of the King of Wing event zone or not participating in the event.
