BACKGROUND:

The developer’s agreement is for a commercial subdivision with 17 lots, 12 tracts, and 2.04 miles of road.

The zoning for the property is Planned Development (PD).

The developer is KL Winding Oaks LLC.

SW 54th Court Road and SW 67th Lane will be publicly maintained along with the potable water and sanitary sewer systems.

The Property Owners’ Association will own and maintain the drainage retention areas, the conveyance system outside of the dedicated public right of way, and all common areas for landscaping and pedestrian access.

Site plans are required to develop the individual lots.

Lot owners will maintain the improvements constructed on the individual lots.

FINDINGS AND CONCLUSIONS:

                     The developer’s agreement must be approved prior to recording of the plat.

                     Platting is required for the creation of the individual commercial lots.

                     Final plat approval is no longer required by the City Council and will be handled administratively.

                     Site plans have been submitted for multiple lots and are under review.

Staff recommends approval of the developer’s agreement.

 

FISCAL IMPACT:

Potable water and sanitary sewer systems for the subdivision will be publicly maintained following the standard maintenance period.
