BACKGROUND:  On April 4, 2023, City Council adopted guidelines concerning whether former attorneys (W. James Gooding II and Robert Batsel, Jr.) “participated personally and substantially” in a matter involving land use, zoning, and other real estate entitlements. Mr. Gooding is requesting to represent 17th Street Ocala, LLC (the principal of which is Harvey Vandeven) and 1333, LLC (the principals of which are Lance and Pat Schenker) in connection with the possible rezoning of property they each own on SE 17th Street between SE 14th Avenue and SE 12th Avenue.

 

FINDINGS AND CONCLUSIONS:  After reviewing old land use and zoning cases from over 20 years ago related to these properties, it was determined that Mr. Gooding was not involved. Staff has no issues with Mr. Gooding representing the clients concerning the rezoning.
