BACKGROUND:
The Bellechase Subdivision is a gated community with private roads, where street lighting is the responsibility of the Homeowners’ Association (HOA). Ocala Electric Utility (OEU) has installed and maintained private area lighting fixtures, poles, and wiring in the subdivision in accordance with approved rate tariffs. These high-pressure sodium (HPS) lights, installed over several years, are now considered legacy equipment, as identical decorative replacements are no longer available. Following an April 2024 rate increase, the HOA expressed interest in assuming ownership of the private lighting equipment and maintenance.
FINDINGS AND CONCLUSIONS:
OEU and the HOA have agreed to transfer ownership of all lighting fixtures, poles, and cabling to the HOA at no cost. The HOA will be responsible for all maintenance and replacements and will continue paying a fixed monthly rate per light to cover power costs.
If the agreement is not approved, the HOA has the option to continue utilizing the existing Private Area Lighting service from OEU or terminate those services and install its own new LED lighting system.
Staff recommends approval of the Legacy Lighting Transfer Agreement with the Bellechase Homeowners’ Association.
FISCAL IMPACT:
This is a no-cost transaction.

This Agreement has been reviewed by the Procurement & Contracting Officer in compliance with City policy.
LEGAL REVIEW:
This Agreement will be reviewed and approved for form and legality by City Attorney, William E. Sexton.
