BACKGROUND:  The plat was previously submitted for consideration and approved by City Council on November 5, 2024, subject to updating the title opinion.  However, prior to the plat being recorded, the owner of the Market Street at Heath Brook conveyed two of the outparcels created by this plat.  The sale of these lots was discovered when the title opinion was updated prior to recordation.  As a result, the new owners, Heathbrook PAD I, LLC and Heathbrook PAD II, LLC, have been added to join in the plat dedication, correctly reflecting ownership.

 

Case No. SUB23-45407 (final plat) was recommended for approval by the Planning and Zoning Commission on May 12, 2025.

 

FINDINGS AND CONCLUSIONS:

                     Plat boundaries and the number of lots have not been changed from the prior approval.

                     Title opinion requires updating prior recordation.

                     A site plan is required at the time of development of the two new outparcels.
