BACKGROUND:
The primary purpose of the request is to consolidate, update, and restate the Original 163 agreement and subsequent amendments into a single integrated concurrency agreement for administrative clarity and easier future administration. Additionally, the Agreement memorializes the rezoning to Planned Development (PD25-0001), approved on May 5, 2026, and the Traffic Study (TIA25-0003), approved on March 19, 2026. The project has Planned Development (PD) zoning (approximately 252 acres) and includes single-family residences, multi-family residences, commercial, retail, office, recreational outdoor uses, and other allowed uses.
On January 13, 2004, the City of Ocala and the original property owner Larry M. Wood, as Trustee, entered into a Concurrency Development Agreement establishing and reserving transportation concurrency capacity for what is known as the “Eastern Property” of the current KAS Planned Development. Since adopting the original concurrency agreement, the subject properties have changed ownership several times.
The current owner, KAS Ocala, LLC (Owner), acquired the property and submitted a request to enter into an Amended and Restated Concurrency Development Agreement (Agreement) pursuant to Chapter 163, Florida Statutes. The benefits, reservations, and obligations reflected in the prior agreement are preserved except as expressly modified. Further, the agreement shall be for a period of 30 years commencing on the effective date, unless it is extended by mutual consent of the Parties in accordance with Section 163.3229, Florida Statutes.
