BACKGROUND:

The City of Ocala (City) Water Resources Department was approached to supply central water and wastewater services to the Birge & Held Ocala apartment complex by New Ocala, LLC (Developer). This agreement will cover approximately 264 apartment units.

 

FINDINGS AND CONCLUSIONS:

                     Though the infrastructure is not in place for the City to provide the utility services to the project, the City has agreed to provide the Birge & Held Ocala apartment complex with central water and wastewater services pursuant to the terms and conditions of this Agreement and the City Code.

                     Prior to the commencement of construction by the Developer, the City and Developer shall cooperate to determine whether Utility Plan Alternative #1 or Utility Plan Alternative #2 shall be constructed by the Developer set forth in the plans for the property pursuant to the terms and conditions of this Agreement.

                     The Developer shall pay all applicable fees (including impact fees) in accordance with the City Code and other applicable laws and ordinances.

                     Staff recommends approval.

 

FISCAL IMPACT:

Upon completion, this project is estimated to return annual gross revenues of approximately $144,429 to the Water Resources Department. The annual net revenue is estimated to be $133,499.

LEGAL REVIEW: The Agreement will be reviewed and approved for form and legality by the City Attorney, Robert W. Batsel, Jr.
