BACKGROUND:
* Applicant: Lakay Properties, LLC
* Property Owner: Lakay Properties, LLC
* This property is located east of SW 24th Avenue at the southwest corner of Scott Springs Park and north of the existing multi-family development (Grand Reserve Apartments).
* The applicant is planning to construct a 12-unit townhome development. If the rezoning is granted, any use permitted in the R-3 zoning district, including multi-family apartments, may be located on the subject property.
* The future land use category on this property is Low Intensity. The R-3 zoning district is compatible with this land use.
* The subject property was intended to be used for the Shady Road multi-family development. The Shady Road development reached the density allotment leaving this piece of property undeveloped.
* This property was part of the developer's agreement that required the previous owner to pay $25,000 to the City related to potential Scott Springs improvements. The city did receive the $25,000 from the previous owners.
* Planning & Zoning Commission recommended approval by a vote of 6 to 0.
FINDINGS AND CONCLUSIONS:
The R-3 zoning district is consistent with the Low Intensity future land use classification and with the surrounding area. Staff recommends approval of the requested zoning designation.
