BACKGROUND:

Existing fences associated with the Vaneldiks’ property encroach onto the City of Ocala’s Right of Way at four separate locations. Additionally, the City of Ocala’s existing paved roadway along a portion of SE 12th Street (North) encroaches onto the Vaneldiks’ property at one location. Each encroachment is demonstrated on the attached survey. City staff and the Vaneldiks propose to enter into an Encroachment Agreement to resolve the referenced encroachment issues.  

 

FINDINGS AND CONCLUSIONS:

The attached Agreement accomplishes the objective of allowing the owner to avoid removal of the existing fence in the areas of encroachment and allowing the City to avoid relocating the existing roadway pavement in the area of encroachment.  Staff from the City’s Survey and Engineering Divisions has reviewed the matter and recommends approval of the agreement.
