BACKGROUND:
The Winding Oaks Residential Phase 4A plat was recorded on September 8, 2025, for 123 lots, nine tracts, and 1.33 miles of road.
The original developer’s agreement addressed the construction and maintenance of the subdivision improvements.
Winding Oaks Residential Phase 4 conceptual subdivision plan was approved to be developed in three sub-phases.
Winding Oaks Residential Phase 4B final plat has been submitted and is under review.
Section 4.14 of the original agreement addressed the need for streetlights pursuant to Section 70-621 of the Code of Ordinance.
The developer and city staff continue to work toward a resolution on this topic.
FINDINGS AND CONCLUSIONS:
The original agreement required resolution within one year of the agreement's effective date.
The first amendment extends the timeframe to the earlier of recording the subsequent phases or one year after the amendment's effective date.
Winding Oaks Residential Phase 4B plat cannot be approved and recorded without the amendment.
Only Section 4.14 of the original agreement is being amended. All other terms and conditions shall remain in full force and effect.
