BACKGROUND:

This is a request to approve an Encroachment Easement into and over a portion of  NW 18th Avenue for adjacent Parcel #22621-000-00. A portion of the home constructed on this property in 1938, as well as a porch, steps, walkway and fencing are constructed within the NW 18th Avenue right-of-way. The improvements lie on the shoulder of the roadway. Granting an easement provides for the continued use and maintenance of the improvements by the owner, removes the title defect, enabling the owner to sale the property with a clear title.

FINDINGS AND CONCLUSIONS:

The proposed encroachment easement has been reviewed by the City’s Engineering Department and staff recommends approval.

This Agreement has been reviewed by the City’s Procurement and Contracting Officer in compliance with City policy.
