BACKGROUND: The developer is Emerson Pointe Development, LLC and initially submitted the subdivision as Carson's Place PH 1. However, during the review process, the developer changed the name of the project to Emerson Pointe Phase I. This property is located on NE 28th Street between NE 19th Avenue and NE 24th Avenue. The property is split between the City and Marion County. The City's portion of the property will be developed into 11 single-family residential lots with R-1AA zoning. The lots will be a minimum of 60 feet by 120 feet with 7,200 square feet of area.
The parcel directly to the north (PID # 24286-000-00) with the same owner is currently zoned PUD for 92 single-family residential lots in the county. Annexation of the remaining property would create an enclave for the properties on NE 19th Avenue. The proposed development will have two points of ingress/egress, one on Northeast 28th Street and NE 35th Street.

The entire project will connect to city water and wastewater utilities. The internal roadways will include a 30-foot right of way with a curb and gutter design. All subdivision improvements are proposed to be publicly maintained.

Case No. SUB22-45024 (conceptual subdivision plan) was recommended for approval by the Planning and Zoning Commission on August 14, 2023.
FINDINGS AND CONCLUSIONS: The City Engineer approved the developer's request to reduce the right-of-way to 30 feet to match the road width within the county portion of the project. A typical minimum right-of-way width for city roadways is 50 feet. The eleven city lo...
