BACKGROUND:
This agreement is for a single-family residential subdivision consisting of 70 lots, eight tracts, and 0.61 miles of road on 23.49 acres.
Key Points:
* The developer is West Oak Developers, LLC.
* The agreement addresses the construction and maintenance of the subdivision improvements.
* Roadways, storm water conveyance system within the dedicated public right-of-way, potable water, and sanitary sewer systems will be publicly maintained.
* Drainage system and retention areas outside of the public right-of-way, signage, along with landscaping and open space areas, will be maintained by the West Oak Master Property Association, Inc.
* A solid waste service fee of $18,550 (70 lots x $265 per lot) is required prior to plat recordation.
FINDINGS AND CONCLUSIONS:
* The Developer's Agreement must be approved prior to plat recordation.
* Final plat is required for creation of individual lots and tracts.
* Final plat approval is no longer required by the City Council.
* The West Oak Concurrency Agreement was approved by the City Council on February 3, 2026, providing concurrency for 892 trips (maximum 1,082 trips at full buildout). Current West Oak approvals include projects totaling 714 trips, including Phase 3.
* Title opinion will require updating before plat recordation.
* Project cost must be certified by the project engineer and submitted for review and approval by the City Engineer.
Staff recommends approval.
FISCAL IMPACT:
The city will assume maintenance responsibilities for roadways, portions of the storm water conveyance, potable water, and sanitary sewer systems after the standard maintenance period.
