BACKGROUND:
Staff requests the approval of an Agreement for Subordination of Utility Interest for two Electric Easements that encumber Marion County Parcel 13539-002-01. The Subordination is in support of the Florida Department of Transportation (FDOT) Interstate 75 Expansion Project. FDOT will cover all expenses related to locating, protecting, adjusting, relocating, or removing City facilities if necessary.
FINDINGS AND CONCLUSIONS:
A Resolution is required to execute the Agreement. Ocala Electric Utility staff has reviewed and accepted the Agreement. Staff recommends approval.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA AUTHORIZING EXECUTION OF A SUBORDINATION OF UTILITIES AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION CONCERNING PROPERTY COMMONLY KNOWN AS FDOT PARCEL 107.04; DIRECTING THAT THE SIGNED RESOLUTION AND AGREEMENT BE FORWARDED TO THE FLORIDA DEPARTMENT OF TRANSPORTATION; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the State of Florida Department of Transportation proposes to construct or improve State Road No. 93 (I-75), Section No. 36210, F.P. No. 435209-1, FDOT Parcel ID 107.04 in Marion County, Florida; and
WHEREAS, it is necessary that certain easement rights presently owned by the City of Ocala, Florida, be subordinate to the rights of the State of Florida Department of Transportation; and
