BACKGROUND:
This developer’s agreement is for a commercial subdivision consisting of three lots, five tracts, and .52 miles of road.
The development of the property involves Scannell Properties #608, LLC, the developer, and Scannell Properties #746, LLC, the Lot 1 owner.
Tract A, NW 11th Street, and all improvements within the dedicated public right-of-way will be publicly maintained.
The commercial lots are subject to a solid waste fee, which will be determined at the time of lot development and assessed 30 days after permanent electric service has been established.
The developer’s engineer has provided a cost estimate, which has been reviewed and approved by the City Engineer’s office for the required assurance. The bond for that amount has been received and is on file.
The individual lot owners will maintain improvements to the lots.
FINDINGS AND CONCLUSIONS:
• The developer’s agreement must be approved prior to recording of the final plat.
• Platting is required for the creation of the individual lots and to extend and replat NW 11th Street.
• Final plat approval is no longer required by City Council and will be handled administratively.
Staff recommends approval of the developer’s agreement.
FISCAL IMPACT:
Potable water and sanitary sewer systems for the subdivision will be publicly maintained following the standard maintenance period.

This Agreement will be reviewed and approved for form and legality by City Attorney, William E. Sexton.
