BACKGROUND:

The subject property is currently located in unincorporated Marion County contiguous to, and surrounded by property that lies within the city limits. The proposed annexation removes an enclave. Additionally, the area being considered for annexation provides infrastructure for property currently within the city limits. The subject property is developed with a drainage retention area that collects stormwater runoff and allows for up to 80 percent impervious area on the lots within the Shops at Foxwood Replat and Foxwood III plat. It is important to note that the maintenance of the drainage retention area is the responsibility of the Association or benefitting lot owners per the Shops at Foxwood Replat.
The petitioner has submitted concurrent applications for a land use change to Low Intensity (Case: LUC24-45697) and rezoning to B-2, Community Business (Case: ZON24-45698).
The Planning & Zoning Commission recommended approval with a vote of 4-0 at their July 8, 2024, hearing.
