BACKGROUND:
Parcel #2390+006-000, belonging to the City, is platted as a Water Retention Area (WRA) and is located adjacent to SW 40th Avenue on the east side of parcel #2390-000-000, belonging to HP Ocala 40th Avenue, LLC. Please refer to the attached aerial view of the parcel. The City's parcel has never been developed as a WRA, nor has it been used or developed for any other purpose by the City. Parcel #2390-000-000 is the parent parcel of the City's parcel. The location of the City's parcel interferes with the proposed development of parcel #2390-000-000. The developer, HP Ocala 40th Avenue, LLC approached the City to discuss what the City could do to solve the interference issues with their development.
FINDINGS AND CONCLUSIONS:
As the City has not developed their parcel into a WRA, does not plan to develop the parcel into a WRA, has no other use for the parcel, and as the parcel belonging to the developer is the parent parcel, staff recommends that the City sell its parcel to the developer to solve the interference issues with the development. HP Ocala 40th Avenue, LLC has agreed and staff therefore recommends approval of the sale and purchase of parcel #2390+006-000 for the appraised value of $94,000.
FISCAL IMPACT:
Revenue from sale to be placed in the Storm Water Professional Services Legal Account #158-020-430-538-53-31020.
