BACKGROUND:
* Petitioner and Property Owner: David Hammar, York Hill Properties LC
* Agent: Sandon Wiechens, Wiechens Realty, Inc.

Key Points:
The petitioner is requesting to rezone 2.04-acres of property from O-1, Office, to B-2A, Limited Community Business.
Zoning and Land Use Factors for Consideration:
* The B-2A district contains a number of new uses that the O-1 district does not allow such as but not limited too; broad mix of general retail, business service, eating or drinking establishments, health care, recreational, and educational uses.
* The subject property's access is from SE 17th Street, a minor arterial roadway.
* The surrounding area is comprised of a mixture of office and commercial properties along the SE 17th Street and SE Magnolia Ave Extension/SE Lake Weir Avenue corridors.

FINDINGS AND CONCLUSIONS:
* Rezoning the property will not result in the creation of a non-conforming use or structure.
* The proposed B-2A zoning district is consistent with the subject property's current Low Intensity Future Land Use designation, the comprehensive plan and land development regulations (pursuant to Section 122-244 of the Code of Ordinances).
* The B-2A zoning district is consistent with the surrounding O-1, SC, and RO zoning designations.
* City utilities are available at this location, and no level of service issues have been identified for public facilities as a result of the zoning amendment.
