BACKGROUND:
The Downtown Parking Garage No. 2 Project (the "Project") consists of conceptual designs, final design, construction documents, and construction services for the construction of a multi-story parking garage with a minimum of 800 parking spaces to be located at the city block encompassed by West Broadway Street to the north, SW Third Avenue to the west, SW Second Avenue to the east and West Fort King Street to the south.
On December 3, 2024, City Council approved and entered into the agreement with SSC Construction Management, LLC ("SSC") for design-build services for the Downtown Parking Garage No. 2 with a Guaranteed Maximum Price (GMP) in the amount of $17,481,485.70 plus a contingency amount of $974,497.30, for a total expenditure of $18,455,983. A Notice to Proceed for the Project was issued on December 4, 2024.
FINDINGS AND CONCLUSIONS:
Page 43, Paragraph 16.3(A) of the Original Agreement required SSC Construction Management, LLC to comply with the provisions of the Davis-Bacon Act (40 U.S.C. 3141-3144, and 3146-3148) as supplemented by Department of Labor regulations.
The First Amendment modifies the Original Agreement by removing the provisions related to the Davis-Bacon Act to comply with the Department of the Treasury's guidance for projects funded with State and Local Fiscal Recovery Funds issued under the American Rescue Plan Act. The removal of the Davis-Bacon Act provisions will decrease the Design-Builder's GMP by $61,375. The Original Agreement...
