BACKGROUND: The Paddock Park Commercial Center was developed in the 1980s as a multi-use commercial subdivision. Lake City Hotels, Inc. has received a request to terminate the original developer's agreement and subsequent amendments affecting the property. Section 2-212 of the City’s Code of Ordinances allows termination of the agreements without council action if all terms of the agreement have been fulfilled and there are no objections from staff.

 

Electric Engineering has requested that language included in the First Amendment to the Developer's Agreement remain in effect to address maintenance and replacement of streetlighting along public road rights-of-way.

 

FINDINGS AND CONCLUSIONS: The maintenance and replacement of streetlighting will remain with the developer and/or association.  The subdivision infrastructure to support the development has been entirely constructed. Staff recommends approval of a partial termination of the agreement.
