BACKGROUND:

The encroachment agreement will accommodate the new District Bar and Grill project located at 110 SW Broadway Street (the location of the former Pi restaurant). The encroachment easement agreement addresses encroachments from an overhang, ramp, grease trap and elevator into the right-of-way along SW Broadway Street and SW First Avenue adjacent to the project area. The sidewalk within the area will need to be replaced and widened to accommodate the encroachments.

The encroachments will allow for greater utilization of the small lot size and permit the development to have an outdoor patio space that will engage the patrons of the downtown area.

 

FINDINGS AND CONCLUSIONS:

The encroachment easement agreement will promote greater utilization of the private and public space. Sidewalk improvements in the right-of-way will be done under the downtown streetscape program.  Staff recommends approval.

 

FISCAL IMPACT:

Sidewalk improvements are estimated to cost $80,000.00.  The cost of the improvements are budgeted in the Downtown Streetscape Project, account # 621-016-012-559-64-63010.
