BACKGROUND:
The City of Ocala's ("City") Water Resources Department was approached by MHC Spanish Oaks, L.L.C. ("Developer") to supply centralized wastewater service to the Spanish Oaks subdivision. This Developer's Agreement will cover approximately 455 dwelling units and two recreation buildings.
FINDINGS AND CONCLUSIONS:
* The City has agreed to provide the Spanish Oaks subdivision with centralized wastewater service pursuant to the terms and conditions of this agreement and the City Code.
* The Developer has agreed to construct, at its sole cost and expense, the improvements which are expressly set forth in the plans for the property pursuant to the terms and conditions of this agreement.
* The Developer shall pay all applicable fees, including impact fees, in accordance with the City Code and other applicable laws and ordinances.
* The Developer shall maintain and repair all improvements for a period of one year after the completion of construction thereof and acceptance by the City. All improvements shall only include: the meters; lift station; and the sanitary conveyance from the lift station to the City's wastewater treatment facility on the property.
* The City already provides water to this subdivision through the Water Extension Developer's Agreement that was approved on 10/23/1984.
* Staff recommends approval.
FISCAL IMPACT:
Upon completion, this project is estimated to return annual gross revenues of approximately $120,922.20 to the Water Resources Department. The annual net revenue is estimated to be $111,780.48.
