BACKGROUND:
City Council entered into a Shady Road planned unit development (PUD) agreement with owner, Thomas L. Croley on September 4, 2001. A first amendment and restated PUD agreement was approved by City Council on June 4, 2002, and a second amendment to the restated PUD agreement was approved by City Council on November 21, 2003.
In paragraph 19 of the restated agreement, the owner agreed to contribute the sum of $75,000 to the City to be used for funding the construction of improvements to Scott Springs Park. An amendment concerning the payment owed under the Shady Road PUD agreement was approved by City Council on February 17, 2015.
In the amendment, the owner agreed to convey a portion of tract A parcel (23721-000-10) to the City in exchange for reducing the contribution sum of $75,000 to $25,000. The owner has conveyed the portion of tract A parcel according to the restated agreement and paid the City $25,000. Recently, the property was rezoned from PUD to R-3.
FINDINGS AND CONCLUSIONS:
* Scott Springs Park is located in the vicinity of the PUD project and contiguous to the tract A parcel.
* Developer agreements provide for a shared investment in community resources that benefit the City of Ocala residents.
* The funds will be used for improvements to Scott Springs Park.
FISCAL IMPACT:
This revenue will be applied to 001-366-000-000-16-36630. Expenses will be applied to 001-021-158-572-69-65010.
