BACKGROUND:

On June 15, 2021, City Council approved the contract for sale and purchase (Contract No: WSD/210567) with Newco Homes of Ocala, Inc.  Below are the stipulations of the agreement:

 

                     The City will own, operate, and maintain the elevated water tank

                     The City will purchase the tank for $200,000

                     The City agrees to install water and sewer lines in the Howard Heights subdivision as part of the purchase of the tower

 

FINDINGS AND CONCLUSIONS:

For the Howard Heights development to move forward, the St. Johns River Water Management District requires two additional provisions for that property. Therefore, Newco Homes of Ocala Inc. (Seller) and the City of Ocala (Buyer) request to amend Paragraph 3.1 of the original contract to include the following language:

                     The Seller shall construct the roads, the drainage systems, and the drainage retention areas

                     The Buyer shall maintain the roads, the drainage systems, and the drainage retention areas.

Staff recommends approval.

This Agreement has been reviewed by the Procurement and Contracting Officer in compliance with the City’s Procurement Policy.
