BACKGROUND:
• The Impact Development Planned Development (PD) Plan proposes the development of 260 multi-family dwelling units, along with amenity buildings and other accessory structures.
• A Traffic Study is required as part of the PD plan review.
• The Traffic Study was approved on December 7, 2023, and identifies certain intersections within proximity to the PD that have a history of crashes or operational deficiencies.
• Certain improvements or modifications to the transportation facilities are necessary to remedy the deficient transportation facilities.
• The Developer has agreed to construct traffic improvements subject to terms outlined in the Developer’s Agreement.
FINDINGS AND CONCLUSIONS: Approval and recordation of the developer’s agreement will allow existing deficient transportation facilities to be sufficiently addressed.
FISCAL IMPACT: The City will support the developer’s request for traffic impact fee credits from the County. In doing so, the developer will construct the improvements instead of the City.

LEGAL REVIEW: This Agreement will be reviewed and approved for form and legality by City Attorney, William E. Sexton.
