Key Points:
The applicant is requesting to abrogate the segment of SW 25th Street located between Blocks 91 and 111 in the West End Ocala Plat which has no utilities and is otherwise undeveloped.
Zoning and Land Use Details:
Prior actions by the Ocala Board of Adjustment and Planning and Zoning Commission were taken without knowledge of the existing City of Ocala right-of-way for SW 25th Street. Specifically, the subject property previously received conditional approvals for a Special Exception to allow a church from the Board of Adjustment, as well as off-site parking within 300 feet from the Planning & Zoning Commission. Required conditions, including conditional site plan approval, have been met as of January 16, 2026. The city attorney has indicated that the prior board actions remain valid subject to the abrogation approval.
The existing SW 25th Street right-of-way was not discovered until further survey and title research was conducted by the applicant through the site plan review process. Approval of the site plan is therefore contingent upon completing this abrogation request.

A RESOLUTION APPROVING RECOMMENDATIONS OF THE OCALA PLANNING AND ZONING COMMISSION FOR THE ABROGATION AND VACATION OF THE SEGMENT OF SW 25TH STREET LYING BETWEEN BLOCKS 91 AND 111 AS SHOWN ON THE WEST END OCALA PLAT, PLAT BOOK A, PAGE 78, OF THE PUBLIC RECORDS OF MARION COUNTY, FLORIDA.
WHEREAS, application has heretofore been made by LEGACY VIEW CHURCH, INC, a Florida limited liability company (“Applicant”) has heretofore made an application to the Ocala Planning and Zoning Commission for the abrogation of the portion of right- of- way (the “Abrogated Right- of-way”) in Ocala, Marion County, Florida, as hereinafter more particularly described; and
WHEREAS, the City of Ocala is the owner of the right-of-way described above; and
WHEREAS, this segment of SW 25th Street right-of-way was not discovered to exist until after previous public hearings with the Board of Adjustment (Special Exception for a church/place of worship with off-site parking) and the Ocala Planning and Zoning Commission (approval for off-site parking) had occurred; and
WHEREAS, the applicant is seeking to abrogate the right-of-way for SW 25th Street to allow for the development of their project; and
WHEREAS, the proposed abrogation was submitted to all appropriate utilities for consideration and no comments or objections were raised.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session as follows:
1. That segment of 25th Street between blocks 91 and 111 as per plat of West End Ocala, Plat Book A, Page 78, lying within section 13, Township 15 South, Range 21 East, of the public records of Marion County, Florida, being more particularly described as follows:
A PORTION OF 25TH STREET BETWEEN BLOCKS 91 AND 111 AS SHOWN ON THE PLAT OF WEST END OCALA, PLAT BOOK A, PAGE 78, OF THE PUBLIC RECORDS OF MARION COUNTY, FLORIDA, LYING WITHIN SECTION 13, TOWNSHIP 15 SOUTH, RANGE 21 EAST, MORE PARTICULARLY DESCRIBED AS FOLLOWS:
