BACKGROUND:

The Recreation and Parks Department is responsible for providing events, concerts, and other performing arts services with national, regional, and local artists throughout the year in community and neighborhood venues around the city. Staff does not have the expertise or the equipment to provide concert production/sound services in-house.

 

The 2017 Arts and Economic Prosperity 5 Study for Ocala and Marion County showed a return of $3 for each $1 spent on cultural arts activities. Events, concerts and performing arts programs are a large part of this return which contributes to a higher quality of life for citizens and the economic vitality of the community. 

 

On July 21, 2022, the City issued its Request for Proposals (“RFP”) No. REC/220663 for concert series production and management services. Five (5) proposals were received and evaluated by the Selection Committee on September 20, 2022.  The three (3) highest-ranked companies were shortlisted and provided presentations to the Selection Committee on October 19, 2022.  Dillon Video and Film Productions, Inc. (“Dillon”) was found to be the highest-ranked firm:

 

 

FINDINGS AND CONCLUSIONS:

 

On November 15, 2022, City Council approved a two-year contract for the provision of concert series production and management services with Dillion Video & Film Productions, Inc. (“Dillon”) in an amount not to exceed $190,000.  Dillon began providing services after the agreement was fully executed on December 12, 2022 and after four months of exhibiting performance which fell below acceptable standards, the City issued a Notice of Default and Termination to Dillon on April 18, 2023, effectively dismissing their contract for services with the City of Ocala.

 

City staff contacted the second highest ranked vendor, Oniram Productions, Inc. (“Oniram”), who agreed to assume the balance of the contract term for REC/220663 and to honor the pricing submitted with its original proposal.  The contract with Oniram will not exceed the balance of $142,350 remaining under the original agreement and Oniram is capable of providing the provide the resources needed to continue to provide the high-quality concerts, performing arts and events. 

 

In addition to production services, Oniram will assist in negotiating contracts with national and regional acts to obtain the best artist price, provide contracts for regional company representatives and concert equipment, assist in sponsorship development, assist in branding aspects including guidance on additional performance opportunities, and act as a resource for other City sponsored events as requested by the City. 

 

This agreement is for a term of two (2) years, with two (2) optional two-year (2-Year) renewal terms available. Each concert production will be negotiated and pre-approved on a task work order basis.

 

FISCAL IMPACT:

The two-year contract for concert production services for community events, concerts and performing arts programs is $190,000.  Funds are budgeted annually in the Recreation and Parks Department budget (001-021-138-579-57-34010 and 001-021-134-574-57-34010).  

 

PROCUREMENT REVIEW:

These services were procured in compliance with the City’s Procurement Policy.

This Agreement will be reviewed and approved for form and legality by City Attorney, William E. Sexton.
