BACKGROUND:

This agenda item is a proposed Developer’s Agreement for Greenway Reserve, a single-family residential subdivision consisting of 55 single-family lots, five tracts, and 0.54 miles of road on 12.67 acres.

Key Points:

•                     The developer is the Boyd Real Estate Group.

•                     The agreement addresses the construction and maintenance of the subdivision improvements.

•                     Facilities including roadways, storm conveyance system within the dedicated public right-of-way, potable water, and sanitary sewer systems will be publicly maintained.

•                     The Greenway Reserve Homeowners’ Association, Inc. will maintain drainage retention areas and conveyance systems outside of the public right-of-way.

•                     In lieu of construction, the City Engineer has approved a contribution to the sidewalk fund in the amount of $37,500 for the sidewalk required along NE 25th Avenue.

•                     A solid waste service fee of $14,575 (55 lots x $265 per lot) is required prior to plat recordation.

•                     A tree shall be planted on each lot prior to issuance of the certificate of occupancy for any single-family residence constructed. The tree must be at least 3.5-inch caliper diameter measured at six inches above ground level in accordance with the plans approved for the subdivision.

Infrastructure improvements are substantially complete, and the developer is ready to submit for final plat review.

City Council approval of a developer’s agreement is required prior to the final plat submittal. Final plat approval is no longer required by City Council.

The project engineer must certify the final project cost for review by the City Engineer.
