BACKGROUND:
This is a new Circle K Store currently under construction at 4755 W. Hwy 40. Circle K Store, Inc., doing business as Circle K #6867, requests a permit for beer and wine package sales in sealed containers; no sales by the drink or consumption on premises.

• Request: The purpose of this request is approval of a State 2APS alcohol permit to allow beer and wine package sales in sealed containers, no sales by the drink or consumption on premises, Circle K Stores, Inc., doing business as Circle K #6867; hours will be 24 hours per day, 7 days per week. (Code of Ordinances Section 6-5 limits the hours and times during which alcoholic and intoxicating beverages may be sold, consumed, or served, or permitted to be served or consumed, in any place or on any premises defined as a business establishment as follows: for each day of the week except Sunday, between the hours of 7 a.m. and 2 a.m. the following day. On Sunday, Alcoholic beverages may be sold for consumption on the premises only, between the hours of 11 a.m. and 2 a.m. on Monday; and beer, ale, and wine may be sold in sealed containers for consumption off the premises only, between the hours of 7 a.m. on Sunday and 2 a.m. on Monday.)

FINDINGS AND CONCLUSIONS:
This request is for a provisional location permit, subject to the applicant satisfying the requirements of the City’s Code of Ordinances Section 6-32(d) to obtain their appropriate state-issued license.

Proximity to other Alcohol Beverage Establishments: None within the 500-foot radius.
