BACKGROUND:
On April 19, 2022, the City of Ocala (City) entered into an agreement for donated right of way to acquire property for the construction of SW 44th Avenue. As part of the agreement to acquire the property, the City agreed to construct a roundabout at the intersection of the proposed east-west and the north-south roads.
On January 16, 2024, City Council approved a Construction Services Agreement (Contract No. CIP/230697) between the City and Commercial Industrial Corp (CIC) for the construction of Phase 1B of the SW 44th Avenue Extension Project (the “Project”) in the amount of $8,814,840, plus a 10% contingency to cover unforeseen conditions and other issues which may arise during construction. As advertised, the Project's initial design did not include the construction of a roundabout.
On August 21, 2024, the City Engineer executed Change Order #1 to Contract No. CIP/230697 to utilize $200,060.20 in Council-approved contingency funds to cover additional unit items and rates to address unforeseen conflicts with utilities and sidewalk placement. Change Order #1 increased the contract sum to $9,014,900.50, leaving a contingency balance of $681,423.80.
FINDINGS AND CONCLUSIONS:
The City Engineering Department is now requesting approval for authorization to execute Change Order #2 to add an additional $1,025,808 to the contract sum for the construction of the proposed roundabout. Current contract pricing from the SW 44th Avenue Extension Phase 1B project was used to generate a proposal for the additional work needed to construct the roundabout.
CIC has done an outstanding job during the construction of SW 44th Avenue. They have met tight deadlines with Saddlewood Elementary School's schedule and have accommodated all others while constructing the project.
This Change Order will increase the contract sum of Contract No. CIP/230697 to $10,040,707.52, plus a contingency balance of $681,423.80.
Staff recommends approval to provide the additional funding to construct the roundabout.
FISCAL IMPACT:
The Infrastructure Surtax Reserve account (120-099-999-541-81-99999) is an appropriate use for the project funding in the amount of $1,025,808. The funds will be transferred to the project expense account which is 120-020-386-541-69-65010.

A RESOLUTION AMENDING THE FISCAL YEAR 2024-25 BUDGET TO TRANSFER FUNDS FROM INFRASTRUCTURE SURTAX RESERVE TO SUPPORT THE CONSTRUCTION OF A ROUNDABOUT ON SW 44TH AVENUE IN THE AMOUNT OF $ $1,025,808
WHEREAS, on April 19, 2022, the City of Ocala (City) entered into an agreement for donated Right of Way to acquire property for the construction of SW 44th Avenue.; and
WHEREAS, the initial design of the project that was advertised for SW 44th Avenue did not include the construction of a roundabout.; and
WHEREAS, the City Engineering Department is requesting approval for authorization to execute a change order for the construction of the proposed roundabout.; and
WHEREAS, an additional $1,025,808 is needed for construction; and
WHEREAS, the Infrastructure Surtax Reserve account is an appropriate use for the project funding.
NOW THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, duly assembled in regular session, that the FY2024-25 budget be amended as outlined below to appropriate funding as follows:
