BACKGROUND: The proposed residential subdivision, comprising 11 single-family residential lots and an entrance road, is being developed by Emerson Pointe Development, LLC, with the plat prepared by JCH Consulting Group, Inc. The property is located on NE 28th Street, between NE 19th Avenue and NE 24th Avenue, as seen in the attached location map. The development spans two jurisdictions, with portions located in the City of Ocala and Marion County. The City of Ocala will assume responsibility for maintaining the entire subdivision's potable water and sanitary sewer systems. However, the Homeowners Association will privately maintain all roadways, drainage retention areas, and the drainage system.

A residential sanitation fee totaling $2,915, calculated at $265 per lot for the 11 houses within the city limits, is due. The county portion of the plat was recorded on October 2, 2024, while the city plat must be recorded before the sale of any city lots. Additionally, the title opinion for the development must be updated before the plat can be officially recorded.

Case No. SUB23-45387, which pertains to the final plat for this subdivision, was recommended for approval by the Planning and Zoning Commission on January 13, 2025. This approval supports the continued development process and aligns with the city and county's jurisdictional requirements.

FINDINGS AND CONCLUSIONS: The development represents a collaborative effort between jurisdictions and private entities to provide new housing while ensuring that essential utilities and systems are properly maintained under defined responsibilities. Steps to finalize the plat include the timely recordation of the city portion and the title opinion update, both of which are prerequisites for proceeding with lot sales.
