The subject property was once part of a 72-acre Planned Unit Development (PUD) named Shady Road PUD. The Shady Road PUD was approved in November 1996 and underwent four amendments between 1999 and 2003. In 2005, Tract C of the Shady Road PUD was replated and recorded as the Florida Professional Park PUD with an associated amended Concurrency Development Agreement. The subject property consists of Lots 3, 4, and 5 within Block “A” of the Florida Professional Park subdivision. The associated PUD plan has nine underlying conditions and condition number six states, “No parking will be allowed in the front yard along SW 34th Street Road (also known as SW 24th Avenue).”

A major site plan was submitted for review, and staff found that the proposed site layout did not conform to the associated PUD. The applicant subsequently requested a modification to the PUD due to the subject property’s existing topography and noted challenges for the building placement within the site. Specifically, the property slopes vertically, approximately 17 feet from the southwest portion of the property to the northeast portion.

 

 

Planning and Zoning Commission:

Staff presented the PUD amendment request to the Planning and Zoning Commission at the December 9, 2024, meeting. During the meeting, staff asked that the request be limited to lots 3,4 and 5 in Block A. The applicant agreed to the modification.

The Planning and Zoning Commission voted six to zero to recommend approval to the City Council with the staff-recommended condition.

 

FINDINGS AND CONCLUSIONS:

As proposed by the applicant, removing the note in its entirety raised concerns, as prior development within the PUD complied with this restriction. However, topographical challenges for the subject property are unique and not as pronounced on other properties fronting SW 24th Street Road within the PUD.  Placing the building on the east portion of the site (to accommodate parking to the rear as currently required), would necessitate significant earthwork and infrastructure improvements to prevent water run-off impact to the proposed structure. Rather than removing condition number six in its entirety, the Planning & Zoning Commission recommends the following condition of approval for this amendment:

“No parking will be allowed in the front yard along SW 34th Street Road (also known as SW 24th Avenue), except for Lots 3, 4, and 5 of Block A.

The proposed condition exempts the applicant’s properties from compliance with the current restriction while maintaining the restriction for other properties fronting on S.W. 34th Avenue as approved in the original PUD plan.

Parking will still meet the applicable O-1, Office District, 25-foot front yard setback required by the approved PUD, which references Section 122-286, Ocala Code of Ordinances.

Staff recommends approval.

A RESOLUTION APPROVING AN AMENDMENT OF THE FLORIDA PROFESSIONAL PARK PUD (FORMERLY KNOWN AS SHADY ROAD PUD), PLANNED UNIT DEVELOPMENT, AMENDING A NOTE PROHIBITING PARKING IN THE FRONT YARD ALONG SW 34TH STREET ROAD (ALSO KNOWN AS SW 24TH AVENUE) RELATING TO A 2.78 ACRE PROPERTY (LOT 3, 4, and 5 of Block A) LOCATED NORTHWEST OF THE INTERSECTION OF SW 32ND PLACE AND SW 24TH AVENUE (PARCEL 23719-001-03) (CASE: PH24-0001).

 

Whereas, an application has been made by the property owner (Sylvester, LLC) to amend the Florida Professional Park PUD plan by removing General Note 6 on Sheet 1 of the Amended Final PUD; and

 

Whereas, the property slopes vertically, approximately 17 feet from the southwest portion of the property to the northeast portion; and

 

Whereas, placing the building along SW 34th Steet Road will require additional earthwork and infrastructure to prevent water run-off impact to the proposed building; and

 

Whereas, the 25-foot front yard along SW 34th Street Road is sufficient to buffer the parking lot; and

 

Whereas, on December 9, 2024, the Planning and Zoning Commission, in regular session, considered the applicant’s request and recommended approval of an amendment with a condition that note 6 on the PUD plan state’s “No parking will be allowed in the front yard along S.W. 34th Street Road (also known as S.W. 24th Avenue), except for Lots 3, 4, and 5 of Block A.” by a six to zero vote.

 

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session, as follows:

 

The City of Ocala hereby approves an amendment to the Florida Professional Park PUD plan (dated May 2, 2013, stamped reviewed and approved by the City on May 8, 2013), to change General Notes number 6 on Sheet 1 of the Amended Final PUD to read as follows:

 

6. No parking will be allowed in the front yard along S.W. 34th Street Road (also known as S.W. 24th Avenue), except for Lots 3, 4, and 5 of Block A.

 

All other Plan notes remain unchanged.
