BACKGROUND:

 

The Ocala City Council will hold a first public hearing on Tuesday, May 3, 2022, to consider a Concurrency Development Agreement to be entered into pursuant to Sections 163.3220 through 163.3243, Florida Statutes, between the City of Ocala (City) and Cradle Holdings (Owner). The Ocala City Council will hold a second public hearing on the proposed Concurrency Development Agreement on Tuesday, May 17, 2022, at 4:00 PM.

 

The property is approximately 1,008.97 acres, located off SR 200 between SW 66th Street and SW 60th Ave. The City approved a rezoning to a Planned Development (PD) zoning district, Conceptual Site Development Plans, and PD Development Guidelines on October 17, 2017, and April 20, 2021. The Owner intends to develop the property as a mixed-use development, including retail and commercial uses, offices, residential uses, and continuation of existing agricultural uses for a portion of the property.

 

FINDINGS AND CONCLUSIONS:

 

The proposed Concurrency Development Agreement addresses the reservation of capacity (3,568 net new external PM peak hour trips) for the 1,008.97 acres. The reservation of capacity granted to Owner by the City shall have a term commencing on the Effective Date of this Agreement and ending on December 31, 2040.

The reservation is based on approved traffic studies dated August 11, 2017, and January 25, 2021, for the Winding Oaks Planned Development. The approved traffic studies identified a deficient road segment on SW 42 Street from SW 27th Avenue to SW 7th Avenue and multiple intersections based on the proposed trips generated by the development.

 

FISCAL IMPACT:  Pursuant to the provisions of Section 163.3180 of the Florida Statutes, the agreement identifies proportionate share percentage payments of $1,083,909.00 to the County and $4,749,487.00 to the City to address the deficient facilities.
