• Police Presence: There have been 199 calls for service at the subject property during the past two years. An in-house criminal history check was conducted on Pinal Patel. No arrests or DUIs were found.
o Primary reasons for calls for service as identified by Ocala Police Department (OPD):
§ 106 - Security Duty
§ 37 - Citizen Assist
§ 13 - Disturbance
o There was one incident of felony narcotic possession and one death, where foul play was not suspected.
o Due to the high volume of calls for service, additional coordination was conducted with OPD to obtain further information regarding the nature of the occurrences. A full description of the occurrences and OPD's clarification is included as an attachment to this report.
o Location report is attached.
• Request: The purpose of this request is for approval of a State 4COP alcohol permit to allow the sale of beer, wine, and liquor for on-premises consumption at La Quinta Inn & Suites for the area defined by the attached lobby plan. The hours will be 11 a.m. - 2:00 a. m. Sunday - Monday. (Code of Ordinances Section 6-5 limits the hours and times during which alcoholic and intoxicating beverages may be sold, consumed or served, or permitted to be served or consumed, in any place or on any premises defined as a business establishment as follows: for each day of the week except Sunday, between the hours of 7 a.m. and 2 a.m. the following days. On Sunday, Alcoholic beverages may be sold for consumption on the premises only, between the hours of 11 a.m. and 2 a.m. on Monday; and beer, ale, and wine may be sold in sealed containers for consumption off the premises only, between the hours of 7 a.m. on Sunday and 2 a.m. on Monday.)
• Staff Comments: Comments were requested from Growth Management, the Police, and Fire Departments, along with legal review by the City Attorney, and no objections were raised. In response, OPD compared the activity with that of another large hotel in the city and did not identify the call volume as unusual. OPD further indicated that the call volume is generally consistent with activity associated with larger hotel properties and that many of the calls involve routine security duties and citizen contacts. As a result, no concerns were identified by OPD that would warrant an objection to the request.
FINDINGS AND CONCLUSIONS:
This request is for a provisional location permit, subject to the applicant satisfying the requirements of the City’s Code of Ordinances Section 6-32(d) to obtain their appropriate state-issued license.
Proximity to schools, churches, and daycare centers: None within a 500-foot radius.
Proximity to other Alcohol Beverage Establishments: There are four within the 500-foot radius.
• El Toreo Restaurant - 4COP allows businesses to sell beer, wine, and distilled spirits for consumption on the premises, as well as packaged sales in sealed containers.
• Ocala Hilton Hotel - 4COP allows businesses to sell beer, wine, and distilled spirits for consumption on the premises, as well as packaged sales in sealed containers.
• BP (2 ARYAN INC) - 2APS Beer and wine for sale in sealed containers and for consumption off premises only.
• The Flame - 4COP allows businesses to sell beer, wine, and distilled spirits for consumption on the premises, as well as packaged sales in sealed containers.
• CHILI'S GRILL & BAR #189 - 4COP allows businesses to sell beer, wine, and distilled spirits for consumption on the premises, as well as packaged sales in sealed containers.
