BACKGROUND:

• Annexation of the subject property is requested. It is appropriate to assign a city land use and zoning designation. Low-intensity land use is requested with a B-2, Community Business, zoning.
• The property is located one block north of US Highway 27, a predominantly non-residential corridor. Existing land uses within a one-mile radius of the site include mostly Medium and Low Intensity uses.
• Shopping Centers including ancillary uses such as restaurants, indoor recreation, and discount stores are located to the east and west of the property.
• The developer has expressed interest in developing the property as a hotel. There is an Interstate 75 interchange approximately one mile from the subject property.
• Planning & Zoning Commission recommended approval by a vote of 5-0 at the January 9, 2023, meeting.
FINDINGS AND CONCLUSIONS:
The requested zoning classification of B-2, Community Business, District is consistent with the land development regulations and is compatible with the surrounding area. Staff recommends approval.

ORDINANCE 2023-32
AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF OCALA, FLORIDA, CHANGING FROM B-2, COMMUNITY BUSINESS (COUNTY), TO B-2, COMMUNITY BUSINESS (CITY), FOR CERTAIN PROPERTY LOCATED NORTH OF THE ACCESS ROAD INCLUDED IN THE SHOPS AT FOXWOOD REPLAT, SAID ACCESS ROAD RUNNING BEHIND PROPERTIES ADDRESSED 4579 TO 4631 NW BLITCHTON ROAD, OCALA, FLORIDA (CASE NO. ZON22-45048); PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session, as follows:
Section 1. The following described lands are hereby rezoned and reclassified according to the zoning regulation of the City of Ocala, Florida, as B-2, Community Business (City):
LOT 2, FOXWOOD III, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 14, PAGE(S) 197 THROUGH 198, OF THE PUBLIC RECORDS OF MARION COUNTY, FLORIDA, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

Section 2. The zoning map of the City of Ocala is hereby amended to reflect the change in zoning classification from B-2, Community Business (County), to B-2, Community Business (City), as to lands described in Section 1 of this ordinance.
Section 3. Severability Clause. Should any provision or section of this ordinance be held by a Court of Competent jurisdiction to be unconstitutional or invalid, such decision shall not affect the validity of the ordinance as a whole, or any part thereof, other than the part so declared to be unconstitutional or invalid.
Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
Section 5. This ordinance shall become effective upon the later of:
(a). Approval by the mayor, or upon becoming law without such approval; or
(b). The effective date of Ordinance No. _____ (Ref: Land Use Case LUC22-45047).
