BACKGROUND:  On December 17, 2019, the City Council adopted a resolution required by state law to allow the operation of a cardroom on the Ocala Breeders’ Sales (OBS) property.  Currently, OBS has a pending petition with the Florida Gaming Control Commission for a license, scheduled for a hearing on September 7, 2023. OBS is requesting to amend the resolution to clarify the new address for the cardroom is 1781 SW 60^th Avenue. 

FINDINGS AND CONCLUSIONS:  The resolution to change the address is needed and staff recommends approval.

A RESOLUTION CLARIFYING THE APPROVAL OF THE OPERATION OF A CARDROOM AT A FACILITY (1781 SW 60th AVENUE) OWNED AND OPERATED BY OCALA BREEDERS' SALES COMPANY, INC.

WHEREAS:

A.                      Resolution 2020-11 adopted by the City Council of the City Council on the 17^th day of December 2019 approved the operation of a cardroom at Ocala Breeders' Sales Company, Inc. ("OBS").

B.                     OBS has requested the City Council of the City of Ocala to clarify the location for the operation of the cardroom to the contiguous Marion County, Florida, Parcel Account Numbers 23320-005- 01 and 23320-004-01 in Ocala, Marion County, Florida (a legal description of which is included in the Final Order Granting Modification to Permit dated June 28, 2018 by the Division of Pari- Mutuel Wagering of the State of Florida Department of Business and Professional Regulation DBPR Case No. 2018-05116), having situs addresses as follows:

C.                     On September 05, 2023, Ocala City Council considered such a request and approved the activity by a majority vote.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session duly assembled as follows:

1.                     The City of Ocala, pursuant to a majority vote of the City Council of the City of Ocala, approves the operation of a cardroom at the OBS situs addresses referred to above.
