BACKGROUND:

                     Applicant: Lakay Properties, LLC

                     Property Owner: Lakay Properties, LLC

                     This property is located east of SW 24th Avenue at the southwest corner of Scott Springs Park and north of the existing multi-family development (Grand Reserve Apartments).

                     The applicant is planning to construct a 12-unit townhome development. If the rezoning is granted, any use permitted in the R-3 zoning district, including multi-family apartments, may be located on the subject property.

                     The future land use category on this property is Low Intensity. The R-3 zoning district is compatible with this land use.

                     The subject property was intended to be used for the Shady Road multi-family development. The Shady Road development reached the density allotment leaving this piece of property undeveloped.

                     This property was part of the developer’s agreement that required the previous owner to pay $25,000 to the City related to potential Scott Springs improvements. The city did receive the $25,000 from the previous owners. 

                     Planning & Zoning Commission recommended approval by a vote of 6 to 0.

 

FINDINGS AND CONCLUSIONS:

The R-3 zoning district is consistent with the Low Intensity future land use classification and with the surrounding area. Staff recommends approval of the requested zoning designation.

ORDINANCE 2022-74

 

AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF OCALA, FLORIDA, CHANGING FROM PUD-08, PLANNED UNIT DEVELOPMENT, TO R-3, MULTI-FAMILY RESIDENTIAL, FOR CERTAIN PROPERTY (PARCEL # 23721-000-10) LOCATED ALONG SW 24TH AVENUE (CASE NO. ZON22-44741); PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE.

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session, as follows:

 

                     Section 1.  The following described lands are hereby rezoned and reclassified according to the zoning regulation of the City of Ocala, Florida, as R-3, Multi-Family Residential:

 

COMMENCE AT AN 8" CONCRETE MONUMENT INDICATED AS MON. 5 AS PER PLAT OF "TAYLOR FIELD", PLAT BOOK "C", PAGE 74, PUBLIC RECORDS OF MARION COUNTY, FLORIDA, SAID POINT ALSO BEING THE N.E. ALONG SAID EAST BOUNDARY PROJECTED INTO THE PERPALL GRANT 1169.77 FEET; THENCE N.90°00'00"W. 622.14 FEET TO THE POINT OF BEGINNING; THENCE: CONTINUE N.90°00'00"W. 253.30 FEET TO AN INTERSECTION WITH THE EASTERLY RIGHT OF WAY OF S.W. 24TH AVENUE (WIDTH VARIES) SAID POINT LYING ON A CURVE CONCAVE WESTERLY AND HAVING A RADIUS OF 810.00 FEET; THENCE NORTHWESTERLY ALONG THE ARC OF SAID CURVE A CENTRAL ANGLE OF 13°11'23" AN ARC DISTANCE OF 186.46 FEET, AND BEING SUBTENDED BY A CHORD BEARING OF N.21°06'05"W. A DISTANCE OF 186.05 FEET; THENCE DEPARTING SAID EASTERLY RIGHT OF WAY N.58°48'03"E. 268.11 FEET; THENCE S.01°56'18"W. 80.32 FEET; THENCE S.21°58'35"E. 250.38 FEET TO THE POINT OF BEGINNING.

                     Section 2.  The zoning map of the City of Ocala is hereby amended to reflect the change in zoning classification from PUD-08, Planned Unit Development to R-3, Multi- Family Residential, as to lands described in Section 1 of this ordinance.

 

                     Section 3.  Severability Clause.  Should any provision or section of this ordinance be held by a Court of Competent jurisdiction to be unconstitutional or invalid, such decision shall not affect the validity of the ordinance as a whole, or any part thereof, other than the part so declared to be unconstitutional or invalid.

 

                     Section 4.  All ordinances or parts of ordinances in conflict herewith are hereby repealed.

 

                     Section 5.  This ordinance shall take effect upon approval by the Mayor, or upon being law without such approval.
