BACKGROUND:

                     Originally part of the Munden’s Subdivision Plat recorded in March 1982, the lot(s) have remained vacant and undeveloped.

                     The property has faced City Code Enforcement action for removing trees prior to site plan approval. The owners have paid all fines that have been assessed. If they do not come into compliance with an approved plan, additional fines may be assessed.

                     87 vehicular PM peak hour trips are projected.  This number does not exceed 100 PM peak hour trips and therefore, a full traffic study is not required.

                     The PD plan includes 88 single-family homes with enhanced design features, including Florida-friendly plantings in the buffers and open space, pedestrian walking trails, and enhanced landscaped entrances.

                     The Planning & Zoning Commission recommended approval with a 4-0 vote at their March 11, 2024, meeting.

 

FINDINGS AND CONCLUSIONS:  The PD plan and standards are consistent with the land development regulations, and compatible with the surrounding area. Staff recommends approval.

RESOLUTION 2024-22

 

A RESOLUTION APPROVING A PLANNED DEVELOPMENT (PD) PLAN AND ASSOCIATED PD STANDARDS BOOK (PINE OAKS PRESERVE PD) FOR PROPERTY LOCATED IN THE 1100 BLOCK OF NW 14TH STREET, OCALA, MARION COUNTY, FLORIDA (CASE NO. PD23-45351).

 

Whereas, Smart Fill Investment, LLC submits a PD plan (Case PD23-45351) for property located in the 1100 Block of NW 14th Street, approximately 16.58 acres to allow for the construction of 88 single family residential homes, including Florida-Friendly plantings in the buffers and open space, pedestrian walking trails, and enhanced landscaped entrances;

Whereas, as an associated Ordinance 2024-28 amends the zoning map of the City of Ocala changing parcel 25773-000-00 from R-3, Multi-family residential, to PD, Planned Development;

Whereas, on March 11, 2024, the Planning and Zoning Commission recommended approval of the applicant’s request by a four to zero vote;

 

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session, as follows:

1.                     The City of Ocala does hereby approve the Pine Oaks Preserve PD plan (Exhibit “A”) and PD standards book (Exhibit “B”).

2.                     The effective date for this resolution will be May 7, 2024.

3.                     The approved PD plan and associated PD standards book shall apply to the following described land located in Ocala, Marion County, Florida, to wit:

BLOCKS 6, 7, 14 AND 15; LOTS 2 AND 3, OR WEST 1/2 OF BLOCK 8; AND LOTS 2 AND 3, OR WEST 1/2 OF BLOCK 13, MUNDEN'S SUBDIVISION, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK A, PAGE 76, PUBLIC RECORDS OF MARION COUNTY, FLORIDA.

4.                     A certified copy of the Resolution shall be recorded by the Clerk of the City of Ocala in the public records of Marion County, Florida.
