BACKGROUND:

The Florida Department of Transportation (FDOT) is prepared to undertake Financial Project Number (FPN) 452635-1-52-01 (Project), the resurfacing of State Road 25/State Road 200 (US 27/US 301/US 441) from SW 10th Street to SW Fourth Street, in accordance with its adopted work program.

 

The project includes roadway resurfacing, reconstructing curb ramps to meet ADA criteria, signing and pavement marking, and replacement of existing signal vehicle detection loops.  The project also includes resurfacing within the City of Ocala (City) rights-of-way at various intersecting streets along US 441.

 

FINDINGS AND CONCLUSIONS:

FDOT will undertake and complete the construction of the off-system components of the Project for the benefit of the City, including construction engineering and inspection (CEI) and post-design services that may be necessary for the Project.  FDOT requires this Resolution and Off-System Construction and Maintenance Agreement and grants permission to FDOT, its contractor, representatives, employees, and agents to enter and construct improvements within City rights-of-way.

 

Staff recommends approval of the Off-System Construction and Maintenance Agreement with FDOT.

RESOLUTION 2026-45

 

RESOLUTION TO APPROVE THE OFF-SYSTEM CONSTRUCTION AND MAINTENANCE AGREEMENT BETWEEN THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION AND THE CITY OF OCALA

 

Whereas, the State of Florida Legislature has approved and mandated the State of Florida Department of Transportation (Department) to complete various projects included in the Department’s Work Program; and

 

Whereas, included in the Department’s Work Program is Financial Project Number (FPN) 452635-1-52-02, the resurfacing of State Road 25/State Road 200 (US 27/US 301/US 441) from SW 10th Street to SW Fourth Street, located in Marion County, Florida (the Project); and

 

Whereas, due to the direct impact of the Project on off-system roadways that are under the jurisdiction of the City of Ocala (City), it is necessary for the Department to enter onto the City’s roadways and to construct certain improvements; and

 

Whereas, the Off-System Construction and Maintenance Agreement grants permission to the Department, its contractor, representatives, employees, and agents to enter and construct improvements within City rights-of-way.

 

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session duly assembled that the City Council President is hereby authorized to make, execute, and deliver to the State of Florida Department of Transportation the Off-System Construction and Maintenance Agreement for the project known as FPN 452635-1-52-01.
