BACKGROUND:

                     Applicant: Gator Trust Holdings, LLC

                     Property Owner: Gator Trust Holdings, LLC

                     Agent: Rodney K. Rogers

                     Subject property was approved for a rezoning from B-2, Community Business, to B-4, General Business, in June 2022.

                     The M-2, Medium Industrial portion of the property was not rezoned during this time, though it was the intention of the applicant to rezone the entire property.

                     This rezoning is to ensure consistency in approved documents while rezoning the entire property to B-4, General Business.

                     The client is requesting the rezoning to allow for all uses permitted in the B-4, General Business, zoning district.

                     There was a site plan preapplication meeting in October 2022 outlining plans to develop the southern portion of the property as a 114-room hotel.

 

Planning & Zoning Commission recommended approval with a 6-0 vote at their meeting on November 14, 2022.

 

FINDINGS AND CONCLUSIONS:  The B-4, General Business, zoning district is consistent with the Employment Center future land use classification. The proposed zoning is consistent and compatible with the surrounding area. Staff recommends approval.

ORDINANCE 2023-25

 

AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF OCALA, FLORIDA, CHANGING FROM M-2, MEDIUM INDUSTRIAL, AND B-4, GENERAL BUSINESS, TO B-4, GENERAL BUSINESS, FOR CERTAIN PROPERTY LOCATED AT THE SOUTHEASTERN CORNER OF I-75 NORTH BOUND AND NW BLITCHTON RD (US HWY 27) (CASE NO. ZON22-45003); PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE.

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session, as follows:

 

                     Section 1.  The following described lands are hereby rezoned and reclassified according to the zoning regulation of the City of Ocala, Florida, as B-4, General Business:

 

The land referred to herein below is situated in the County of MARION, State of Florida, and described as follows:

A PORTION OF THE WEST 1/2 OF THE NW 1/4 OF SECTION 11, TOWNSHIP 15 SOUTH, RANGE 21 EAST, MARION COUNTY, FLORIDA, LYING EAST OF INTERSTATE HIGHWAY NO. 75 AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

                     Section 2.  The zoning map of the City of Ocala is hereby amended to reflect the change in zoning classification from M-2, Medium Industrial, and B-4, General Business, to B-4, General Business, as to lands described in Section 1 of this ordinance.

 

                     Section 3.  Severability Clause.  Should any provision or section of this ordinance be held by a Court of Competent jurisdiction to be unconstitutional or invalid, such decision shall not affect the validity of the ordinance as a whole, or any part thereof, other than the part so declared to be unconstitutional or invalid.

 

                     Section 4.  All ordinances or parts of ordinances in conflict herewith are hereby repealed.

 

                     Section 5.  This ordinance shall take effect upon approval by the Mayor, or upon being law without such approval.
