BACKGROUND:
The Florida Department of Transportation (FDOT) is prepared to undertake Financial Project Number (“FPN”) 439234-1-52-01, State Road (SR) 200 from I-75 to US 301 Resurfacing, in accordance with its adopted five-year work program. The purpose of this project is to provide operational and safety improvements along SR 200 from east of Interstate 75 (I-75) to South Pine Avenue (U.S. 301) in Ocala. The project scope includes:
• Resurfacing
• Replacing segments of the existing center two-way left turn lane with raised medians
• Pedestrian safety enhancements including improved crosswalks, sidewalk curb ramp reconstruction to current Americans with Disabilities Act (ADA) standards, and construction of new sidewalk to fill existing gaps throughout the project corridor.
• Construction of three midblock crossings equipped with overhead Pedestrian Hybrid Beacons (“PHBs”) between SW 35th Terrace and SW 34th Avenue, between SW 32nd Avenue and SW 26th Street, and between SW 12th Avenue and SW 10th Avenue. PHBs are pedestrian-activated signals that display a red light to stop traffic and allow the pedestrian to cross
• Signalization and lighting upgrades
• Landscaping in median and roadside
To meet ADA standards and establish a connection to the current signal infrastructure, enhancements and general construction work must be carried out within the City's rights-of-way at different intersections along SR 200.
FINDINGS AND CONCLUSIONS:
FDOT shall be responsible for preparation of design plans, rights-of-way acquisition, bidding, construction, and inspection for the project. This Resolution and License Agreement is required by FDOT and grants permission to FDOT, its contractor, and representatives to enter and construction improvements within City rights-of-way.
Staff recommends approval of the License Agreement with FDOT.

This Licensing Agreement has been reviewed by the Procurement and Contracting Officer in compliance with City policy.
LEGAL REVIEW:
This Agreement will be reviewed and approved for form and legality by City Attorney, William E. Sexton.

RESOLUTION 2024-7
RESOLUTION TO APPROVE THE LICENSE AGREEMENT BETWEEN THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION AND THE CITY OF OCALA
WHEREAS, the State of Florida Department of Transportation is prepared, in accordance with its adopted Five-Year Work Program, to undertake the Project described as “State Road 200 from I-75 to U.S. 301 Resurfacing" in Fiscal Year 2023-2024, said Project being known as FPN 439234-1-52-01; and
WHEREAS, the project includes general construction activities within City rights-of-way at various intersecting streets along SR 200; and
WHEREAS, the State of Florida Department of Transportation has requested the City of Ocala to execute and deliver to the State of Florida Department of Transportation the License Agreement for the project FPN 439234-1-52-01; and
WHEREAS, the License Agreement grants permission to the Florida Department of Transportation, its contractor, and representatives to enter and construction improvements within City rights-of-way.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session duly assembled that the City Council President is hereby authorized to make, execute and deliver to the State of Florida Department of Transportation the License Agreement for the project known as FPN 439234-1-52-01.
