BACKGROUND:
On April 4, 2017, City Council approved the Agreement for Metropolitan Area Network (“MAN”) Services, Contract No. TEL/17-141, for Ocala Fiber Network’s (“OFN’s”) provision of fiber optic connectivity to the School Board of Marion County (the “Original Agreement”). The Original Agreement was for an initial term of three years and included four (4) one-year renewal terms. Under this agreement, OFN provides fiber optic interconnectivity to the School Board of Marion County’s (the “School Board’s”) schools, department sites, and Data Center.
The first renewal under the Original Agreement was approved by City Council on January 21, 2021, for the term commencing July 1, 2021, through June 30, 2022. The second renewal under the Original Agreement was approved by City Council on April 5, 2022, for the term July 1, 2022, through June 30, 2023. The Original Agreement is now in its third renewal term, approved by City Council on February 21, 2023, for the period July 1, 2023, through June 30, 2024.
On September 8, 2022, City and School Board entered into a First Amendment to the Original Agreement to remove the connection at Marion Youth Academy and to change the name of the connection at Evergreen Elementary School to Fordham Early Learning Academy.
FINDINGS AND CONCLUSIONS:
The parties now desire to enter into a Second Amendment to the Original Agreement to add a new connection at the School Board’s Central Warehouse located at 2091 NE 35th Street, Ocala, FL 34479, and to exercise the fourth and final renewal option available, thereby extending the agreement through June 30, 2025.
Ocala Fiber Network seeks approval to enter into the Second Amendment to the Agreement for Metropolitan Area Network Services, which will generate revenue in the amount of $67,096, for the remainder of the Original Agreement. The School Board’s Fourth Renewal Agreement which will formally renew the Original Agreement for the final term is anticipated to be received prior to June 30, 2024. Ocala Fiber Network also requests authorization for the Chief Financial Officer to execute said Fourth Renewal, so long as the fiscal impact does not exceed Council thresholds.
FISCAL IMPACT:
The revenue will be added to account number 490-343-000-000-02-34914 in the Fiscal Year 2023-24 and Fiscal Year 2024-25 budgets.
PROCUREMENT REVIEW:
These services are being provided in compliance with City policy.
LEGAL REVIEW:
This Second Amendment will be reviewed and approved for form and legality by City Attorney, William E. Sexton.
