BACKGROUND:

                     Applicant:                      1011 MLK, LLC

                     Property Owner:                     1011 MLK, LLC

                     The applicants are requesting B-4 zoning to allow a vehicular sales use.

                     The property is located adjacent to existing automobile dealerships and surrounded by properties zoned B-4.

                     The above-stated factors make the site a viable location for commercial development allowable in the B-4 zoning district.

                     The future land use classification on this property is Low Intensity.

                     The Ocala Planning & Zoning Commission recommended approval by a 6 to 0 vote.

 

FINDINGS AND CONCLUSIONS:

The B-4 zoning district is consistent with the Low Intensity future land use classification and with the surrounding area. Staff recommends approval of the requested zoning designation.

ORDINANCE 2022-14

 

AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF OCALA, FLORIDA, CHANGING FROM M-1, LIGHT INDUSTRIAL, TO B-4, GENERAL BUSINESS, FOR CERTAIN PROPERTY LOCATED AT 1011 SW MARTIN LUTHER KING JR. AVENUE, OCALA, FLORIDA (CASE NO. ZON21-44561); PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE.

 

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session, as follows:

 

                     Section 1.  The following described lands are hereby rezoned and reclassified according to the zoning regulation of the City of Ocala, Florida, as B-4, General Business:

 

THE NORTH 255.00 FEET OF THE SOUTH 505.00 FEET OF THE FOLLOWING DESCRIBED TRACT:

 

COMMENCING AT THE NW CORNER OF SECTION 19, TOWNSHIP 15 SOUTH, RANGE 22 EAST, MARION COUNTY, FLORIDA, THENCE S.02°01'30"W. 112.01 FEET ALONG THE WEST BOUNDARY OF SAID SECTION 19 FOR THE POINT OF BEGINNING, THENCE NORTHEASTERLY ALONG THE SOUTH RIGHT OF WAY LINE OF STATE ROAD #200 ON A CURVE CONCAVE SOUTHEAST (HAVING A CENTRAL ANGLE OF 20°04'51", A RADIUS OF 1084.24 FEET) FOR A DISTANCE OF 380.00 FEET, WHOSE RADIUS POINT BEARS S.02°18'19"E; THENCE S.00°30'30" W.899.48 FEET TO A POINT ON THE NORTH RIGHT OF WAY LINE OF SOUTHWEST 12TH STREET, A 60 FOOT RIGHT OF WAY; THENCE WEST 390.28 FEET ALONG SAID NORTH RIGHT OF WAY LINE; THENCE ALONG THE WEST BOUNDARY OF SAID SECTION 19, N.02°01'30"E. 819.13 FEET TO THE POINT OF BEGINNING: EXCEPTING FROM THE SAID NORTH 255.00 FEET, THE WEST 20 FEET THEREOF.                      Section 2.  The zoning map of the City of Ocala is hereby amended to reflect the change in zoning classification from M-1, Light Industrial, to B-4, General Business, as to lands described in Section 1 of this ordinance.

 

Section 3.  Severability Clause.  Should any provision or section of this ordinance be held by a Court of Competent jurisdiction to be unconstitutional or invalid, such decision shall not affect the validity of the ordinance as a whole, or any part thereof, other than the part so declared to be unconstitutional or invalid.

 

                     Section 4.  All ordinances or parts of ordinances in conflict herewith are hereby repealed.

 

                     Section 5.  This ordinance shall take effect upon approval by the Mayor, or upon being law without such approval.
