BACKGROUND:
On January 7, 2020, City Council approved the original grant agreement with the Florida Department of Environmental Protection (FDEP). The primary objective of the project is to design and construct a sanitary sewer system that will remove from service a package plant that serves approximately 350 mixed-use residential lots and a community center. State funding in the amount of $750,000 for the project was eligible for work performed on or after July 1, 2019, until September 30, 2020.
On July 8, 2020, a change order was executed to extend the project completion date to March 21, 2021. On February 2, 2021, Amendment 1 was approved to extend the expiration date to September 30, 2022. Amendment 2 will extend the project completion to December 31, 2024.
FINDINGS AND CONCLUSIONS:
• The original agreement was set to expire on September 30, 2020.
• Due to the COVID-19 Emergency Order, the completion date was extended to March 31, 2021.
• Due to delays related to materials and unresolved issues of assets and easement between the City and Sun Communities, Inc., the completion date was extended to September 30, 2022.
• Due to delays relating to materials the new requested anticipated completion date is December 31, 2024.
FISCAL IMPACT:
This Amendment does not augment the original fiscal impact.

The Second Amendment has been reviewed and approved in compliance with the City’s Procurement Policy.
LEGAL REVIEW:
The Second Amendment will be reviewed and approved for form and legality by the City Attorney, Robert W. Batsel, Jr.
