BACKGROUND:
The Recreation and Parks Department and Cultural Arts Division are responsible for providing events, concerts, and performing arts programming featuring national, regional, and local artists across various community venues. The City does not have the in-house expertise or equipment required to provide concert production or sound services.
After a competitive solicitation, City Council approved a two-year contract with Dillon Video and Film Productions, Inc. (Dillon) for concert series production and management services in an amount not to exceed $190,000 for a two-year term, November 16, 2022, through November 15, 2024, with two optional two-year renewal terms. After four months of performance that failed to meet contractual standards, the City issued a Notice of Default and Termination to Dillon on April 18, 2023.
City staff subsequently contacted the second-highest-ranked proposer from the original solicitation, Oniram Productions, Inc. (Oniram), which agreed to assume the remaining term of the contract at the pricing submitted in its original proposal.
On May 16, 2023, City Council approved the Agreement for Concert Series Production and Management Services (REC/220663) with Oniram in an amount not to exceed $142,350 for an initial term May 6, 2023, through November 15, 2024, with two optional two-year renewals.
On August 6, 2024, City Council approved the First Amendment to the Agreement, in an amount not to exceed $308,000, for a two-year term November 16, 2024, through November 15, 2026.
FINDINGS AND CONCLUSIONS:
Oniram has consistently provided exceptional concert production and management services. Their professionalism, responsiveness, and attention to detail have materially contributed to the success of City events.
The Second Amendment to the Agreement, in an amount not to exceed $300,000, represents the final two‑year renewal option available under the original contract. The renewal term is November 16, 2026, through November 15, 2028.
Each concert production will continue to be negotiated and approved on a task-work-order basis.
Based on their strong performance record and the City’s continued need for these services, staff recommends approval of the final two-year renewal of Oniram’s contract.
FISCAL IMPACT:
The two-year contract renewal for concert production services will not exceed $300,000. Funds are budgeted annually within the Recreation and Parks Department (001-021-134-574-57-34010) and the Growth Management/Cultural Arts Department (001-016-138-579-57-34010) budgets.
PROCUREMENT REVIEW:
These services were procured in compliance with the City’s procurement policy.
LEGAL REVIEW:
This Agreement has been reviewed and approved for form and legality by City Attorney, William E. Sexton.
