BACKGROUND:
• This property is located on SE 24th Street. There is an existing single-family residential unit on the property.
• Ownership of SE 24th Street was recently transferred from Marion County to the City of Ocala. The City is not obligated to maintain the road until such time as the road is constructed to City standards.
• The surrounding properties are either existing residential uses or zoned to allow residential uses. There is a M-2, Medium Industrial property adjacent to the property. Fluid Routing Solutions currently operates on the premises.
• Policy Ordinance 5617 was recently amended from permitting a 180 single-family dwelling unit development to allow a 320 multi-family unit development or a mix of residential types such that traffic impacts do not exceed that of 180 single family units.
• The future land use classification on this property is Low Intensity.
• The property owner is processing a Chapter 163 concurrency development agreement to address traffic mitigation, access, buffers, permitted uses, height restrictions, lighting, signage and architectural requirements.
FINDINGS AND CONCLUSIONS:
The R-3 zoning district is consistent with the Low Intensity future land use classification and with the surrounding area. Staff recommend approval of the requested zoning designation.

AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF OCALA, FLORIDA, CHANGING TO R-3, MULTI-FAMILY RESIDENTIAL, FOR CERTAIN PROPERTY LOCATED AT 2550 SE 24TH STREET, OCALA, FLORIDA (CASE NO. ZON21-44541); PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session, as follows:
Section 1. The following described lands are hereby rezoned and reclassified according to the zoning regulation of the City of Ocala, Florida, as R-3, Multi-Family Residential:
PARCEL NO. 1:
THAT PART OF THE NORTH 16 CHAINS OF THE NORTHWEST QUARTER (NW ¼) OF THE NORTHWEST QUARTER (NW ¼) LYING NORTH OF THE A.C.L RAILROAD IN SECTION 27, TOWNSHIP 15 SOUTH, RANGE 22 EAST, MARION COUNTY, FLORIDA. EXCEPT SOUTHERLY 50 FEET AND EXCEPT EASTERLY 50 FEET
AND ALSO
EASEMENT FOR INGRESS AND EGRESS OVER THE NORTH 50 FEET OF THE EAST 50 FEET OF NORTHWEST QUARTER (NW ¼) OF NORTHWEST QUARTER (NW ¼) OF SAID SECTION 27, MARION COUNTY, FLORIDA.

Section 2. The zoning map of the City of Ocala is hereby amended to reflect the change in zoning classification to R-3, Multi-Family Residential, as to lands described in Section 1 of this ordinance.
Section 3. Severability Clause. Should any provision or section of this ordinance be held by a Court of Competent jurisdiction to be unconstitutional or invalid, such decision shall not affect the validity of the ordinance as a whole, or any part thereof, other than the part so declared to be unconstitutional or invalid.
Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
Section 5. This ordinance shall take effect upon approval by the Mayor, or upon being law without such approval.
