BACKGROUND:

Phase 3 of the Winding Oaks Planned Development is comprised of a single-family residential subdivision consisting of a total of 503 lots on 135.61 acres with Planned Development (PD) zoning

The developer is KL Winding Oaks LLC.

The agreement addresses the construction and maintenance of the subdivision improvements.

 

Roadways, drainage system, and retention areas will be maintained by the Community Development District (CDD) and the Homeowners’ Association (HOA).

Potable water and sanitary sewer systems are being dedicated for public maintenance.

A solid waste service fee of $35,245.00 (133 lots x $265.00 per lot) is required prior to plat recordation for Phase 3A. Additional solid waste service fees will be due at the time of the platting of the lots for each of the remaining sub-phases. The total solid waste service fee due for residential Phase 3 is $133,295. 

 

City Ordinance Section 70-621 requires the developer to install streetlights on all streets internal to the project. The city and developer do not agree that this section also requires installation on external roads adjacent to the project, and are still in active discussions.

 

Prior to recording subsequent plats for the development, the developer shall make provisions for streetlights in accordance with City Ordinance, but in no case more than one year from the effective date of the agreement.

 

Sumter Electric (SECO) will be responsible for providing electric service for Phase 3.

 

 

FINDINGS AND CONCLUSIONS:

                     Developer’s agreement must be approved prior to plat recordation.

                     Platting is required for the creation of the individual lots.

                     Final plat approval is no longer required by City Council.

                     Title opinion provided will require updating prior to plat recordation.

                     Project Engineer must submit either a probable or a certification of cost for the required adequate assurance for review by the City Engineer’s office prior to plat recordation.

Staff recommends approval of the Developer’s Agreement.

FISCAL IMPACT:

The city will assume maintenance responsibilities for the potable water and sanitary sewer systems following the standard maintenance period.
