BACKGROUND:
• Petitioner/Property Owners: CC BB Properties, LLC
• Agent: John C. Counts, Jr.
Key Points:
The petitioner requests rezoning of the subject properties, approximately 1.11 acres, from R-3 (Multi-Family Residential) and B-4 (General Business) to B-2 (Community Business) to provide a unified zoning designation for the entire property.
Parcel 26119-000-00 is split-zoned: the northern and western portions are zoned R-3, and the southeastern portion is zoned B-4. It is developed with a residence converted into a professional business office.
Parcel 26114-000-00 is zoned R-3 and is undeveloped but has historically been utilized for overflow church parking and an employee break area.
The petitioner submitted a Lot Reconfiguration application in July 2026 to combine the properties, which Planning staff subsequently approved administratively. As of this staff report, the Marion County Property Appraiser has not reflected the reconfiguration, which formalizes the lot reconfiguration process.
Zoning and Land Use Details:
There are several key factors to consider for this zoning amendment request:
• The subject properties are designated Low Intensity Future Land Use, which permits the proposed B-2 zoning district.
• The proposed rezoning will eliminate the existing split-zoning condition and establish a consistent B-2 zoning designation across the subject properties.
• The proposed B-2 zoning will reduce potential commercial intensity in the area by rezoning the B-4 zoned portion of the subject properties to B-2. The amendment will shift the broader range of large-scale general commercial uses in the B-4 zoning district to the community- and neighborhood-scale commercial and office uses found in the proposed B-2 zoning district.
• The density, intensity, and types of uses within the proposed B-2 zoning will complement the existing development pattern of the surrounding area, which consists of residential, institutional, professional office, and commercial uses.
• Properties to the north, across NE 20th Street, have existing B-2 zoning, providing an extension of an existing B-2 zoning district in this area.
• Existing public infrastructure and services are available to serve the subject properties, and no level of service deficiencies are anticipated as a result of the rezoning request.
FINDINGS AND CONCLUSIONS:
• The proposed rezoning is consistent with the Low Intensity Future Land Use designation and is permitted zoning district pursuant to Section 122-244 of the Code of Ordinances.
• The proposed rezoning is consistent with the requirements for the B-2 zoning district, and it will eliminate the existing split-zoning condition on the property, establishing a unified zoning designation across the property.
• The proposed rezoning from B-4 to B-2 will result in a reduction in commercial intensity for the portion of the subject property currently zoned B-4 and is consistent with existing B-2 zoning to the north.
• The density, intensity, and types of uses permitted in the proposed B-2 zoning will complement the existing development pattern of the surrounding area.
• The subject property is served by existing public infrastructure and utilities, and no level of service issues have been identified. Any proposed development of the site will require site plan review and additional level of service analysis for public facilities.
