BACKGROUND:
• Applicant: RM Maricamp, LLC
• Property Owner: RM Maricamp, LLC
• Agent: W. James Gooding III, Gooding & Batsel, PLLC.
• The subject property is part of the Maricamp & 25th Subdivision as well as a chapter 163 development agreement. The final plat is currently under review.
• The property currently has split zoning of OP, Office Park, and O-1, Office District.
• The improvements to SE 25th Avenue are required prior to issuance of any Certificates of Occupancy identified within the chapter 163 development agreement.
• Just south of the subject property is the future location of a recently approved Planned Development.
• The future land use classification on this property is Low Intensity.
Planning & Zoning Commission recommended approval by a vote of four to zero with one recusal at the August 14, 2023, meeting.
FINDINGS AND CONCLUSIONS: The OP, Office Park, zoning district is consistent with the Low-Intensity future land use classification and with the surrounding area. Staff recommends approval.

ORDINANCE 2023-60
AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF OCALA, FLORIDA, CHANGING FROM OP, OFFICE PARK, AND O-1, OFFICE, TO OP, OFFICE PARK, FOR CERTAIN PROPERTY LOCATED APPROXIMATELY 520-FEET SOUTHEAST OF THE INTERSECTION OF SE MARICAMP ROAD AND SE 25TH AVENUE, OCALA, FLORIDA (CASE NO. ZON23-45222); PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session, as follows:
Section 1. The following described lands are hereby rezoned and reclassified according to the zoning regulation of the City of Ocala, Florida, as OP, Office Park:
A PORTION OF LAND LYING IN THE NORTHWEST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 22, TOWNSHIP 15 SOUTH, RANGE 22 EAST, MARION COUNTY, FLORIDA, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCE AT THE SOUTHWEST CORNER OF SAID SECTION 22, THENCE NORTH 00º01'32" EAST, ALONG THE WEST LINE OF SAID SOUTHWEST 1/4, A DISTANCE OF 1399.96 FEET TO THE POINT OF BEGINNING; THENCE NORTH 00º01'32" EAST A DISTANCE OF 497.53 FEET; THENCE SOUTH 89º57'12" EAST, A DISTANCE OF 60.00 FEET; THENCE SOUTH 00º01'32" WEST, A DISTANCE OF 100.00 FEET; THENCE SOUTH 89º57'12" EAST, A DISTANCE OF 487.70 FEET; THENCE SOUTH 00º03'38" WEST, A DISTANCE OF 397.59 FEET; THENCE NORTH 89º56'49" WEST, A DISTANCE OF 547.45 FEET TO THE POINT OF BEGINNING. Section 2. The zoning map of the City of Ocala is hereby amended to reflect the change in zoning classification from OP, Office Park, and O-1, Office, to OP, Office Park, as to lands described in Section 1 of this ordinance.
Section 3. Severability Clause. Should any provision or section of this ordinance be held by a Court of Competent jurisdiction to be unconstitutional or invalid, such decision shall not affect the validity of the ordinance as a whole, or any part thereof, other than the part so declared to be unconstitutional or invalid.
Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
Section 5. This ordinance shall take effect upon approval by the Mayor, or upon being law without such approval.
