BACKGROUND:

On or about October 17, 2023, the City of Ocala conveyed property to Airport 7 Ocala, LLC by a Special Warranty Deed, which was recorded in Book 8179, Page 706 of the Official Records of Marion County, Florida (Attachment 1).

Following review of that deed by subsequent counsel for Airport 7 Ocala, LLC, it was determined that they would prefer that the deed contain additional language concerning the release by the City of the mineral rights for the property pursuant to Section 270.11, Florida Statutes (Attachment 2).

Counsel for Airport 7 Ocala, LLC has prepared a Corrective Special Warranty Deed (Attachment 3) which contains the requested language and has requested approval and execution of the same (Attachment 4).

 

FINDINGS AND CONCLUSIONS:

The City Council of the City of Ocala, Florida, finds, determines, and concludes that the approval of and authorization to execute a Corrective Special Warranty Deed at the request of Airport 7 Ocala, LLC for the property originally conveyed on or about October 17, 2023:

-                     Satisfies the requirement of Section 270.11, Florida Statutes, as it pertains to the release of any reservation of mineral rights for the property;

 

-                     Does not adversely impact the City of Ocala, Florida;

 

-                     Does not result in an impact on the finances of the City of Ocala, Florida;

 

 

-                     Is intended to and does promote and protect the health, safety, and welfare of the citizens of the City of Ocala, Florida; and

 

-                     Is in the best interest of the City of Ocala, Florida, and its citizens.

 

FISCAL IMPACT:

There is no expected fiscal impact for the City of Ocala, Florida.

This Corrective Special Warranty Deed has been reviewed and approved for form and legality by City Attorney, William E. Sexton.
